When Shared Household Rights Meet Senior Citizens Rights A Landmark Delhi HC Decision

The Delhi High Court has held that a daughter-in-law’s right to reside in a shared household under the Domestic Violence Act is a protective right and does not create ownership or proprietary interests in the property. Upholding the eviction order, the Court ruled that such residence rights cannot indefinitely override the right of senior citizens to peacefully enjoy their self-acquired property. The judgment also clarifies that complex disputes relating to inheritance, ancestral property, and financial claims must be adjudicated by competent civil courts and not in summary proceedings under the Senior Citizens Act.
